This Parent Activation Notice explains what happens when you activate a Student Artist's Personal Page, Museum, Museum Shop, or related Digital Project Pages through an Art2fund Inc. ("Art2fund," "we," "us," or "our") Program.
This Notice combines the parent consent terms, activation privacy notice, and artwork/gallery visibility notice for the activation flow. It is intended to be the parent-facing notice shown or linked on the student activation page.
This Notice supplements the Art2fund Terms and Conditions, Art2fund General Privacy Policy, Art2fund Student Data Privacy Policy, checkout terms, and any Program-specific notices presented through the Services. If you do not agree to this Notice, do not activate the Student Artist's Personal Page.
By activating this page, you confirm that you are the parent or legal guardian of the Student Artist, or that you are authorized by the parent or legal guardian. Art2fund will use the Student Artist's Artwork, the student name you provide, the selected class, and your email address to operate this project, create and display the Personal Page, Museum, Museum Shop, applicable Class Gallery and School Gallery, create product previews, process orders, send project-related communications, provide support, protect the Services, and meet legal and operational needs.
Pages and galleries may be accessible by QR code, Access Code, or direct link. Anyone who receives a relevant link may be able to access it.
When you complete Activation, you confirm the following. You can open each linked document before you continue.
I confirm that I am the parent/legal guardian, or authorized by the parent/legal guardian, and I agree to the Art2fund Parent Activation Notice and Art2fund Terms and Conditions. I acknowledge the Art2fund General Privacy Policy and Art2fund Student Data Privacy Policy.
Only a Parent may activate or manage a Student Artist's Personal Page, Museum, Museum Shop, or related Digital Project Pages, unless the Parent has authorized another person to do so.
By completing Activation, you represent and confirm that:
If you are not authorized to activate the page, do not complete Activation. Contact Art2fund or the Participating Organization if you believe you received the wrong flyer, QR code, Access Code, Artwork, or activation link.
Before Activation, a Participating Organization may upload scanned Artwork Sheets. Art2fund may process those scans by separating the designated drawing area from the designated name or class area. At that stage, Art2fund may have only the Artwork image and a separate image of the name or class area, without an activated Personal Page or additional Parent-provided Student Data.
During Activation, Art2fund may ask you to enter or confirm:
Art2fund also automatically receives technical information when you use the activation page, such as IP address, browser and device information, timestamps, log data, and cookie or similar identifiers. Art2fund uses this information to operate and secure the Services, prevent misuse, and record that Activation was completed, including the version of this Notice, the confirmation text shown to you, and the date and time of your confirmation. Cookies and similar technologies are described in the Art2fund General Privacy Policy.
Activation does not create a general student account, parent account, or Buyer account. Access remains tied to the QR code, Access Code, direct link, or other access method associated with the applicable Program materials.
By completing Activation, you consent to Art2fund collecting, using, storing, displaying, sharing, and otherwise processing the Student Artist's Artwork and related Student Data for Program-related purposes.
These purposes may include:
Art2fund does not knowingly require a child to provide more personal information than is reasonably necessary to participate in the applicable Program.
Art2fund does not claim ownership of the original Artwork. Ownership of the original Artwork remains with the Student Artist, Parent, or other person or entity that owns it.
By completing Activation, you grant Art2fund a limited, non-exclusive, royalty-free, worldwide license to copy, scan, upload, crop, resize, edit, color-adjust, enhance, format, display, host, store, reproduce, print, manufacture, process, and otherwise use the Artwork and related information for purposes related to the applicable Program and Services.
This license includes the right to use the Artwork and related information to operate the Program, create pages and galleries, generate flyers and product previews, process orders, produce Products, provide support, prevent fraud and misuse, maintain required records, and improve internal production, quality-control, service, support, security, and operational processes.
Art2fund will not publish or share real Student Artist Artwork, active Personal Pages, active Museums, active Museum Shops, Class Galleries, School Galleries, or related Digital Project Pages for Art2fund's own public advertising, public social media, testimonials, portfolio examples, or unrelated promotional purposes unless Art2fund obtains any separate permission required by law.
After Activation, the Student Artist's Artwork may become visible in one or more of the following places, depending on the Program and settings:
Art2fund's activation flow is designed so that only Artwork from Student Artists whose Personal Page has been activated through the QR-code or Access-Code process, with Parent authorization or other legally valid authorization, becomes visible in a Personal Page, Museum, Museum Shop, Class Gallery, or School Gallery.
If the QR code or Access Code is not used to activate the Personal Page, the Student Artist's project participation ends at the non-activated Artwork stage. Non-activated Artwork should not be published further in a Personal Page, Museum, Museum Shop, Class Gallery, or School Gallery.
The Personal Page is connected to a specific Student Artist's Artwork and is intended for the Student Artist and Parent. It may be accessed through the QR code, Access Code, direct link, or other access method associated with the flyer and Artwork.
The Museum is a student-specific digital presentation page or environment where activated Artwork may be displayed. The Museum is intended for the Parent, Student Artist, family members, friends, supporters, and other invited viewers who receive the relevant direct link, QR code, or Access Code.
The Museum Shop is a student-specific online shop where Buyers may purchase customized Products featuring the Artwork associated with the Student Artist's activated Program participation. Anyone who receives the Museum Shop link may be able to access the Museum Shop and place orders, unless additional controls are configured.
The Class Gallery is part of the Class Website and is intended for Teacher access using login credentials. It is not intended to be shared publicly, posted online, or made available to parents, students, Buyers, family members, friends, supporters, local media, or the general public unless Art2fund and the Participating Organization expressly configure or authorize a separate sharing feature.
The School Gallery may show activated Artwork for Student Artists associated with a Participating Organization. The School Gallery may be available through a direct link. The School Coordinator or Participating Organization decides whether and how to share the School Gallery link, subject to school policies, applicable law, Art2fund terms, privacy notices, and any separate written agreement with Art2fund.
Direct links, QR codes, and Access Codes should be treated as access keys.
Anyone who receives the relevant direct link, QR code, Access Code, screenshot, copied URL, forwarded message, or printed flyer may be able to access the related page or gallery.
Art2fund does not intend active Personal Pages, Museums, Museum Shops, Class Galleries, or School Galleries for real Student Artists to be searchable public profile pages. Art2fund may use technical settings designed to discourage search engine indexing where appropriate.
However, Art2fund cannot guarantee that a direct link, QR code, Access Code, screenshot, copied page content, shared page, or copied URL remains private after it is shared by a Parent, Student Artist, Buyer, Teacher, School Coordinator, Participating Organization, invited viewer, or other recipient. Art2fund also cannot guarantee that every search engine, browser, social platform, message app, preview service, archive service, third-party website, device, or recipient will treat links or copied content as private.
You are responsible for deciding who receives the Student Artist's Personal Page, Museum, Museum Shop, QR code, Access Code, or direct links.
The student name selected by the Parent may be a first name, last name, full name, nickname, initials, or another name chosen by the Parent.
Depending on the Program, page type, Product type, and settings, Art2fund pages or Product previews may display the Artwork, the selected student name, class information, school information, teacher information, Product personalization, or related Program information.
Parent email addresses are not intended to be displayed publicly in Personal Pages, Museums, Museum Shops, Class Galleries, or School Galleries.
Parents should choose the student name they are comfortable having associated with the Artwork in Program pages, galleries, product previews, and ordering flows.
What is shown or selected in the shop preview and checkout flow is generally what will be produced, subject to reasonable production, material, color, placement, scale, texture, and technical variations. Buyers are responsible for checking that the correct Artwork, selected student name, Product options, personalization, and order details are shown before placing an order.
If you or another Buyer places an order through the Museum Shop, Personal Page, School Gallery, online store, or other Art2fund-operated ordering flow, Art2fund Inc. acts as the seller of the Products unless expressly stated otherwise.
Products are custom-made using the Artwork associated with the applicable Student Artist's activated Museum Shop, Personal Page, or ordering flow.
Before placing an order, the Buyer is responsible for reviewing the correct Artwork, student name and class information if shown, Product personalization, Product selections, quantities, options, shipping address, contact details, payment details, applicable sales tax, discounts, total price, and deadlines.
Orders are final immediately after payment is submitted, subject to the cancellation, refund, replacement, and support terms in the Art2fund Terms and Conditions and any checkout policy. If an order has not yet entered production, Art2fund may be able to cancel it, but cancellation is not guaranteed and no fixed cancellation window is promised.
Removal or deactivation of a Personal Page, Museum, Museum Shop, Class Gallery, School Gallery, or direct link does not undo orders already placed.
Art2fund may share Student Data, Artwork, page data, print-ready files, order information, shipping information, support information, and related operational information with service providers and partners as needed to operate the Services, run Programs, process orders, produce Products, deliver Products, provide support, secure the Services, and comply with legal and business requirements.
Service provider categories may include hosting, cloud storage, database, email, production, print, fulfillment, shipping, payment, customer support, security, monitoring, analytics, accounting, tax, legal, insurance, and professional service providers.
Payment information entered by a Buyer may be submitted directly to Art2fund's third-party payment processor. Art2fund may provide basic order and transaction information to the payment processor, but Art2fund does not intend to receive or store full payment card details entered directly with the payment processor.
Art2fund does not sell Student Data. Art2fund does not use Student Data for targeted advertising or profiling. Art2fund does not use Student Data or Student Artist Artwork to train artificial intelligence models. Art2fund does not direct marketing to children.
By completing Activation, you consent to Art2fund using the email address linked to the Personal Page or Artwork to send project-specific communications.
These communications may include:
Art2fund will not use the Parent email address linked to a Personal Page or Artwork for general newsletters, unrelated marketing, or unrelated promotional emails unless the recipient separately opts in or Art2fund is otherwise permitted to do so by applicable law.
Buyers who place guest checkout orders may receive order confirmations, payment messages, shipping updates, customer-service messages, refund or replacement messages, and other order-related communications.
Each Personal Page may include a removal or deletion option. You may also contact Art2fund support to request access, correction, removal, deactivation, deletion, link review, visibility changes, or other review of Student Data connected with the Student Artist's activated Personal Page, Museum, Museum Shop, Class Gallery, School Gallery, or related Digital Project Pages.
Before any Products have been ordered through the applicable Personal Page, Museum Shop, or ordering flow, you may be able to change the Student Artist's name, class, or email address through available Program tools. Before any Products have been ordered, the School Coordinator may also be able to correct the Student Artist's name or class through school administration tools.
After a Product has been ordered, changes may require Art2fund support review because order, production, personalization, fulfillment, accounting, and support records may already depend on the submitted information.
You may withdraw consent by requesting removal or deactivation of the activated Personal Page, Museum, Museum Shop, or related Digital Project Pages. Withdrawal of consent may end the Student Artist's participation in the applicable digital Program features. Withdrawal does not undo orders already placed and does not require Art2fund to delete records that Art2fund needs to retain for production, fulfillment, shipping, replacement, refund, chargeback handling, customer support, Program Proceeds reporting, accounting, tax, legal compliance, security, fraud prevention, dispute handling, backup, or other purposes permitted by applicable law or a written agreement.
Art2fund may need to verify your identity and authority before responding to a request. Art2fund may coordinate with the Participating Organization where a request affects school-controlled records, Class Galleries, School Galleries, Program reporting, school administration tools, school policies, or local sharing decisions.
Participating Organizations and School Coordinators are responsible for collecting, scanning, uploading, reviewing, and submitting Artwork Sheets according to the applicable Program instructions, unless Art2fund has expressly agreed to perform specific steps.
They are also responsible for registering classes and Teacher access where applicable, reviewing uploads and scans, downloading and distributing flyers correctly, distributing QR codes and Access Codes to the correct Student Artists or Parents, deciding whether and how to share School Gallery links, communicating local Program details, and promptly reporting incorrect Artwork associations, incorrect Student Data, privacy issues, security issues, lost credentials, or wrongly shared links to Art2fund.
Parents are responsible for reviewing the Artwork, selected student name, class, Personal Page, Museum, Museum Shop, product previews, and ordering details before sharing links or placing orders. Parents are also responsible for deciding who receives Personal Page, Museum, Museum Shop, QR code, Access Code, or direct links, choosing a student name they are comfortable having associated with the Artwork, and contacting Art2fund if the wrong Artwork, name, class, page, or link is shown.
If you receive or activate the wrong flyer, QR code, Access Code, or Artwork association because of school-side distribution or handling, that is generally the responsibility of the Participating Organization or School Coordinator unless Art2fund expressly caused the issue.
You may not use Art2fund pages, galleries, forms, shops, QR codes, Access Codes, links, or Services to:
Art2fund may refuse to process, publish, display, produce, fulfill, or support any Artwork, User Content, Personal Page, Museum, Museum Shop, gallery, order, or Product if Art2fund reasonably believes that it violates this Notice, the Art2fund Terms and Conditions, applicable Program terms, school policy, or applicable law, or if Art2fund believes it may create legal, privacy, security, safety, reputational, operational, production, or intellectual property risk.
Art2fund's Programs are intended to be organized by Participating Organizations and activated or managed by Parents or legal guardians. Children under 13 should not activate a Personal Page, enter personal information, place orders, or submit information to Art2fund without Parent involvement and authorization.
Where a school or district uses Art2fund for an educational purpose and is legally permitted to provide consent on behalf of Parents under COPPA, Art2fund will use the Student Data covered by that school consent only for the educational or school-authorized purpose and not for unrelated commercial purposes. Art2fund may still provide Parent-facing notices and Parent request options where feasible.
Participating Organizations remain responsible for determining whether FERPA, PPRA, COPPA, state student privacy laws, directory information policies, media release policies, school board policies, district policies, procurement requirements, fundraising rules, or local student privacy rules apply to their Program participation, artwork display, gallery sharing, School Gallery links, parent notices, opt-outs, or permissions.
If Art2fund signs a separate written agreement, district agreement, data processing agreement, student data addendum, or Program-specific agreement with a Participating Organization, that agreement may supplement or control for the subject matter it covers.
Art2fund uses reasonable administrative, technical, and physical safeguards designed to protect Student Data and Program information from unauthorized access, use, disclosure, alteration, loss, or destruction.
No online service, school system, email system, payment provider, hosting provider, carrier, or production workflow can guarantee absolute security. You should protect QR codes, Access Codes, direct links, usernames, passwords, and other access methods and share them only with people you want to have access.
Contact Art2fund promptly if you believe a QR code, Access Code, direct link, Personal Page, Museum, Museum Shop, Class Gallery, School Gallery, Artwork association, order, or Student Data has been accessed, activated, shared, or used incorrectly.
This Notice is part of the agreement between you and Art2fund for Activation and related use of the Services.
The Art2fund Terms and Conditions apply to broader use of the Services, including ordering, payments, sales tax, shipping, Products, refunds, replacements, intellectual property, disclaimers, limitation of liability, indemnification, suspension, termination, governing law, dispute resolution, arbitration, class-action waiver, and miscellaneous legal terms.
The Art2fund General Privacy Policy and Art2fund Student Data Privacy Policy describe Art2fund's broader privacy, Student Data, child privacy, retention, deletion, service provider, and security practices.
How long Art2fund keeps Artwork, activation information, and order records is described in the Retention sections of the Art2fund General Privacy Policy and the Art2fund Student Data Privacy Policy. Depending on where you live, state privacy laws may give you rights such as access, correction, deletion, portability, appeal, and non-discrimination; those rights and how to exercise them are described in the State Privacy Notice section of the Art2fund General Privacy Policy.
If there is a conflict between this Notice and the Art2fund Terms and Conditions about Activation, this Notice controls for Activation. If there is a conflict about privacy, Student Data, child privacy, or data protection, the applicable privacy policy or student data policy controls for that subject matter.
Art2fund may update this Parent Activation Notice from time to time. Updated versions may be posted on the Art2fund website, presented during Activation or checkout, emailed to relevant Users, included in Program materials, or otherwise made available through the Services.
The updated Notice will be effective as of the date stated in the updated Notice or as otherwise permitted by applicable law. Continued access to or use of the Services after an updated Notice becomes effective means that you accept the updated Notice, subject to applicable law.
